Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") are a legal agreement between you and SYNAPSE.EXE LLC, a Michigan limited liability company ("Synapse.exe," "we," "us"), governing your use of the Synapse.exe website, and iOS and Android apps (together, the "App"). By accessing or using the App, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App.

2. Eligibility & who may use Synapse.exe

The App is designed to be used by children and students during practice activities, and by the parents, guardians, teachers, and speech-language professionals who supervise, score, and record that practice ("Professional Users").

• If you are under 18, you may use the practice games and exercises only with the involvement of a parent, guardian, or supervising professional, who is responsible for agreeing to these Terms on your behalf.
• Creating an account, entering another person's information, or using the Client Tracker / Session Recorder requires that you be an adult (18+) acting as a parent, guardian, or qualified professional.
• By creating an account or entering Client Data, you represent that you meet these requirements.

3. Accounts

Some features require an account secured by a password and/or PIN. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly at the email in Section 17 if you suspect unauthorized access.

4. License to use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for its intended personal, educational, or professional practice purposes. You may not sublicense, resell, rent, or provide the App as a hosted service to others.

5. Ownership & intellectual property

The App — including its games, artwork, characters, audio, text, source code, and the "Synapse.exe" name and logo — is owned by SYNAPSE.EXE LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license in Section 4, no rights are granted to you by implication or otherwise.

The App uses the following third-party, open-source, or licensed components under their own terms: the three.js graphics library (MIT License) and Google Fonts typefaces (open-font licenses). These components remain the property of their respective owners.

Any game names, characters, or visual styles in the App are original works created for Synapse.exe or used under license; they are not affiliated with, endorsed by, or sponsored by any third-party game, franchise, or brand that may share a similar theme.

6. Acceptable use

You agree not to:

• Use the App for any unlawful purpose, or in a way that infringes anyone else's rights;
• Attempt to reverse engineer, decompile, or bypass security or access controls in the App, except as permitted by law;
• Upload or enter content you do not have the right to enter (including another person's private or health information without appropriate authorization);
• Interfere with or disrupt the App's operation, or attempt to gain unauthorized access to any account or system;
• Use automated means (bots, scrapers) to access the App outside of normal use.

7. Responsibility for client, student & session data

If you use the Client Tracker, Session Recorder, or similar features to record information about a child, student, or client, you are solely responsible for that data — including having the legal right to collect and store it, complying with any professional, employer, or legal obligations that apply to you (including but not limited to student-records or health-privacy laws applicable in your jurisdiction), and securing the device on which it is stored. SYNAPSE.EXE LLC provides the App as a tool and does not control, review, or take responsibility for content you choose to enter into it.

8. Not medical, legal, or clinical advice

The App is an educational and practice tool. It does not provide medical, clinical, diagnostic, or legal advice, and nothing in the App should be treated as a substitute for the judgment of a qualified professional. Any scores, progress indicators, or reports generated by the App are practice aids only.

9. Free, ad-supported service & refunds

Synapse.exe is free to download and use. We do not offer subscriptions, in-app purchases, or any paid digital goods, and the App does not charge you money through the App itself in any way. The App is supported entirely by third-party advertising (see the Privacy Policy's Advertising section for what that involves and what you can control).

Refund policy: not applicable. Because no financial transaction of any kind occurs within the App, there is nothing to refund and no refund process is needed. If you were charged by an app store (Apple App Store or Google Play) in a way you believe relates to Synapse.exe, that charge did not originate from us — contact the app store directly, as purchases made through their platforms are governed by their own refund policies, not ours.

Ads within the App are provided and selected by Google AdMob and its advertising partners. We do our best to keep ad content appropriate for a kids' educational app through AdMob's content controls, but we do not create, review, or endorse individual ad creatives, and we are not responsible for the content, products, or services advertised by third parties. If you see an ad you believe is inappropriate, contact us using Section 17 and we will investigate.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. BECAUSE MOST DATA IS STORED LOCALLY ON YOUR DEVICE, WE ARE NOT RESPONSIBLE FOR DATA LOSS DUE TO DEVICE FAILURE, LOSS, THEFT, OR UNINSTALLATION OF THE APP; PLEASE MAINTAIN YOUR OWN BACKUPS OF ANY INFORMATION YOU CANNOT AFFORD TO LOSE. NEITHER SYNAPSE.EXE LLC NOR ANY GAME, EXERCISE, SCORE, OR REPORT IN THE APP GUARANTEES ANY PARTICULAR SPEECH, LANGUAGE, OR THERAPY OUTCOME, TIMELINE, OR RATE OF PROGRESS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYNAPSE.EXE LLC AND ITS OWNERS, MEMBERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP. BECAUSE THE APP IS FREE AND YOU DO NOT PAY US ANYTHING, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold harmless SYNAPSE.EXE LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your entry of any third party's (including a client's or student's) personal information into the App without appropriate authorization.

13. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App, and delete your account by contacting us, at any time. Sections that by their nature should survive termination (including Sections 5, 7, 9, 10, 11, and 12) will survive.

14. Governing law & disputes

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any dispute arising from these Terms or the App will be subject to the exclusive jurisdiction of the state or federal courts located in Michigan, and you consent to personal jurisdiction there.

15. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Continued use of the App after a change becomes effective means you accept the updated Terms.

16. General provisions

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the App. Our failure to enforce a provision is not a waiver of it.
